Terms of Service
Effective: 1 March 2026
1. Introduction and Acceptance
Welcome to MACIA (My Aged Care IAT Assistant). MACIA is operated by Big Dog Software (ABN), a sole trader registered in Australia ("we", "us", "our").
By creating an account or using the MACIA service, you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service.
2. Eligibility
You must be at least 18 years of age to use MACIA. If you are using the service on behalf of another person (for example, as a carer, family member, or advocate), you represent that you have the authority to accept these terms on their behalf.
3. Account Registration
To use MACIA's assessment features, you must create an account by providing accurate and complete information. You are responsible for:
- • Maintaining the confidentiality of your account credentials
- • All activity that occurs under your account
- • Notifying us promptly if you become aware of any unauthorised use
We reserve the right to suspend or terminate accounts that violate these terms or our Acceptable Use Policy.
4. Use of the Service
MACIA is a preparation and information tool designed to help people understand and prepare for aged care IAT assessments. It is based on the publicly available IAT User Guide v2.4 (November 2025).
MACIA is not a substitute for professional medical, clinical, legal, or aged care advice. It does not guarantee any particular assessment outcome, classification level, or funding amount.
5. User Content and Data
You retain ownership of all data you enter into MACIA, including assessment answers, personal notes, and demographic information. By using the service, you grant us a limited licence to store, process, and display your data solely for the purpose of providing the MACIA service to you.
You are responsible for the accuracy of the information you enter. Assessment data may include health-related information, which we treat with particular care as described in our Privacy Policy.
6. Assessment Sharing
MACIA allows you to share your assessments with others via secure, time-limited sharing links. When you share an assessment:
- • You control who receives access and can revoke access at any time
- • Recipients can view the shared assessment but cannot modify it
- • Sharing links may have an expiration date
You are responsible for sharing assessments only with people you trust, given the sensitive nature of the information.
7. Intellectual Property
All MACIA application code, design, branding, guidance content, and documentation are owned by Big Dog Software or its licensors and are protected by Australian and international intellectual property laws.
IAT question text referenced within MACIA is sourced from publicly available Australian Government documents and is used for informational and educational purposes.
8. Pricing and Payment
MACIA is currently provided free of charge. We reserve the right to introduce paid features or subscription tiers in the future. If we do so, we will provide reasonable notice, and any changes to pricing will not retroactively affect services already provided to you.
9. Privacy
Your privacy is important to us. Our collection, use, and disclosure of your personal information is governed by our Privacy Policy, which forms part of these Terms of Service. By using MACIA, you consent to our data practices as described in that policy.
10. Disclaimers
MACIA is not affiliated with the Australian Government, the Department of Health and Aged Care, My Aged Care, or any government assessment body.
MACIA does not provide medical advice, clinical assessments, legal advice, or financial advice.
To the maximum extent permitted by law, MACIA is provided "as is" and "as available", without warranties of any kind, whether express or implied.
For a detailed statement of our disclaimers, please see our Disclaimer page.
11. Limitation of Liability
To the maximum extent permitted by Australian law, Big Dog Software shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenue, whether incurred directly or indirectly, or any loss of data, use, or goodwill arising out of your use of or inability to use the MACIA service.
Nothing in these terms excludes, restricts, or modifies any consumer guarantee, right, or remedy conferred on you by the Competition and Consumer Act 2010 (Cth), Schedule 2 (Australian Consumer Law), or any other applicable law that cannot be excluded, restricted, or modified by agreement.
12. Indemnification
You agree to indemnify and hold harmless Big Dog Software from any claims, damages, losses, or expenses (including reasonable legal fees) arising out of your misuse of the MACIA service, your violation of these terms, or your infringement of any third party's rights.
13. Changes to These Terms
We may update these Terms of Service from time to time. When we make material changes, we will update the "Last updated" date at the top of this page and require you to re-accept the updated terms before continuing to use the service. Your continued use of MACIA after re-accepting the updated terms constitutes your agreement to the changes.
14. Termination
You may stop using MACIA and delete your account at any time through your profile settings. We may suspend or terminate your access if you violate these terms or our Acceptable Use Policy.
Upon termination, your right to access the service ceases. You may request a copy of your data before deleting your account by contacting us.
15. Governing Law
These terms are governed by the laws of New South Wales, Australia. You agree to submit to the non-exclusive jurisdiction of the courts of New South Wales for any disputes arising from or relating to these terms or the MACIA service.
